OSP addresses INTERPOL’s action on Ofori-Atta Red Notice

The Office of the Special Prosecutor (OSP) has confirmed that the International Criminal Police Organization has deleted the Red Notice issued at Ghana’s request for former Finance Minister, Ken Ofori-Atta.

In a press release dated February 13, 2026, the OSP said it had received the decision of the Commission for the Control of INTERPOL’s Files (CCF), which directed the removal of the notice in line with the organisation’s rules on political neutrality and notice processing.

According to the statement, the Commission cited contextual factors surrounding the issuance of the alert, including what it described as “polarized political statements from members of current and former administrations about the conduct of the investigation.”

“The Office of the Special Prosecutor (OSP) has received the decision of the Commission for the Control of INTERPOL’s Files concerning the Red Notice issued at Ghana’s request for Mr. Kenneth Nana Yaw Ofori-Atta.

“The Commission directed the deletion of the notice under INTERPOL’s rules on political neutrality and notice processing, citing contextual factors at the time of issuance, including “polarized political statements from members of current and former administrations about the conduct of the investigation,” as well as public controversy surrounding prosecutorial and extradition processes, including public acknowledgment by senior officials at the Ministry of Justice of an inability, at the time, to pursue extradition due to the early procedural stage of the case,” part of the statement said.

It also referenced public controversy regarding prosecutorial and extradition processes.

The Commission further noted that senior officials at the Ministry of Justice had publicly acknowledged, at the time, that extradition could not yet be pursued because the case was still at an early procedural stage.

INTERPOL deletes Red Notice against Ken Ofori-Atta over political concerns

Additionally, the CCF observed that subsequent developments rendered the Red Notice unnecessary.

It pointed out that Ofori-Atta’s location was known, cooperation with authorities in the United States was ongoing, and extradition proceedings had already commenced following his arrest in the US on January 6, 2026.

The OSP disclosed that summons issued by the Criminal Division of the High Court in Accra have been transmitted to the United States for service, requiring Ofori-Atta to appear and answer multiple criminal charges.

The Office emphasised that efforts to secure his appearance in Ghana are continuing through established legal and diplomatic channels.
