The Office of the Attorney General is reportedly set to probe the Office of the Special Prosecutor (OSP) over allegations of unlawful detentions and investigations.

According to a report by thelawplatform, the Deputy Attorney General and Minister of Justice, Dr Justice Srem-Sai, disclosed the move during court proceedings on the OSP’s case against the former Chief Executive Officer of the National Petroleum Authority (NPA), Dr Mustapha Abdul-Hamid, and seven others.

This was after lawyers for the accused persons alleged unlawful detention and investigation during their weekly reporting to the office as part of the bail conditions set by the court.

One of the lawyers, Joseph Dindiok Kpemka, told the presiding judge, Justice Audrey Kocuvie-Tay, that Dr Mustapha Abdul-Hamid and his lawyer, Akbar Alkomeini, were detained for over 5 hours after reporting to the OSP as directed by the court.

A second lawyer, Israel Ackah, who represents the second accused, made similar complaints, saying he suffered the same fate when he went to the office with his client.

NPA Case: High Court rebukes OSP over detention of accused persons – Report

In response, Principal State Attorney Adelaide Kobiri-Woode denied that the OSP was investigating the accused persons over the same case, insisting that the interrogations related to separate matters.

The report noted, however, that Kpemka countered the claim by presenting a letter to the court, which he said showed that the investigations were directly linked to the NPA case already before the court.

Justice Kocuvie-Tay subsequently criticised the OSP’s handling of the matter, stressing that accused persons and their lawyers must not be detained or investigated over issues pending before the court.

She stated that charges should not have been filed if investigations were incomplete. As a result, the judge varied the bail conditions of the accused persons, reducing their reporting schedule at the OSP from weekly to once a month, effective March 2026.

The judge then asked the Deputy Attorney General, who was also in court, to look into the allegations against the OSP.

Dr Srem-Sai, according to the report, assured the judge that his office “shall cause inquiries into the veracity of claims of the accused persons through their lawyers.”
