Deputy Speaker cannot form part of a quorum- UPSG law school Dean faults Joseph Osei-Owusu

The Dean of the University of Professional Studies Law School has faulted Joseph Osei-Owusu for counting himself to form a quorum for the approval of the 2022 budget last Tuesday.

According to Professor Ernest Kofi Abotsi, when the a Deputy Speaker of Parliament assumes the role of a speaker, he assumes the liabilities of the speaker.

He stated that one of the liabilities is that the speaker does not have a vote, be it a casting vote or an original vote.

“When a Deputy Speaker assumes the office of a Speaker, the Deputy Speaker suffers the liabilities of the speaker and one of those liabilities is that the Speaker doesn’t have a vote; he neither has a casting vote nor an original vote but it creates a constitutional problem from what we see now,” he said on Joy FM’s “The Law” programme.

Chaos ensued in parliament last Wednesday when the minority moved a motion to set aside the approval of the budget because it was unconstitutional.

However, the presiding speaker, Joseph Osei Owusu threw out the motion when he should have subjected it to a vote.

This infuriated the minority, resulting in chaos and the whisking away of the speaker’s chair.
