An Abuja Federal High Court has fixed May 25 to hear the suit challenging the nomination of Kwara State Governor, Bukola Saraki as the candidate of the People’s Democratic Party (PDP) for Kwara Central Senatorial District in the last National Assembly election.
The plaintiff, L’aziz Ayinla Jimoh has sued Saraki alongside the Independent National Electoral Commission (INEC), and the People’s Democratic Party (PDP), saying he ought to have automatically become the candidate of the party being the only screened and cleared candidate after the winner of the primary election, Isiaka Gold withdrew from the race.
He is seeking an order nullifying the purported re-run and election of Saraki as the PDP senatorial candidate for Kwara Central Senatorial District at the purported senatorial re-run primary election of the party held in Ilorin on Saturday, January 29, 2011 organized and conducted by the State Executive Committee of the party for being illegal, unconstitutional, unlawful, null and void and of no effect.
He is also seeking a declaration that the purported election of Saraki as the PDP senatorial candidate for the Kwara Central Senatorial District at the purported senatorial re-run primary election of the party held in Ilorin on Saturday, January 29, 2011 organized and conducted by the State Executive Committee of the PDP is illegal, unconstitutional, unlawful, null and void and of no effect.
The plaintiff in an affidavit averred that Saraki and one Yunus Abdul Rahman who both contested the re-run primary were not aspirants at the close of nomination and screening on December 29, 2010 and the primary election which took place on January 7, 2011.
He averred that by the PDP regulations on re-run primaries, only aspirants that were cleared to contest and did contest the primary election are eligible to participate in and be candidates at the re-run election.
It will be recalled that Saraki has since emerged winner of the National Assembly election in the Kwara central senatorial district.
