South Africa submits filing to ICJ over Israel’s non-compliance with its rulings

Cape Town, Aug. 29 (SANA) – South Africa has submitted a comprehensive filing to the International Court of Justice (ICJ) concerning Israel’s failure to comply with the provisional measures ordered by the court in the genocide case Pretoria brought against Israel in 2023.

South Africa’s Department of International Relations and Cooperation said in a statement published on its website that the filing was submitted under Article 11 of the court’s Resolution concerning its internal judicial practice.

The department stressed that the provisional measures ordered by the ICJ are legally binding and that Israel “has not complied with these orders.”

The statement said Palestinian survivors in the Gaza Strip continue to endure further trauma and are being forced to live under dire humanitarian conditions in an increasingly shrinking area.

It added that Israeli violations of the ceasefire in effect since Oct. 10, 2025, have killed more than 1,300 Palestinians and wounded over 4,330 others, while rescue teams have recovered hundreds of bodies from beneath the rubble.

South Africa affirmed that it would continue to use all available avenues to ensure Israel’s full and immediate compliance with the ICJ’s orders. It said the provisional measures are intended to safeguard Palestinians’ rights under the Genocide Convention and prevent irreparable harm to those rights before the court issues its final judgment.

South Africa filed its case against Israel before the ICJ on Dec. 29, 2023, accusing it of violating the 1948 United Nations Convention on the Prevention and Punishment of the Crime of Genocide.

The court issued three provisional-measures orders in January, March and May 2024, directing Israel to take all necessary measures to prevent acts prohibited under the Genocide Convention.

According to figures from the Palestinian Health Ministry, the Israeli genocidal war on the Gaza Strip has killed 73,438 Palestinians and wounded 174,447 others since Oct. 7, 2023.
