Caroli Omondi Explains When Elected Leaders Can Be Recalled From Office

Suba South Member of Parliament Caroli Omondi has explained why elected leaders should not be removed from office simply because of disagreements or personal dislike, stressing the importance of following the law when seeking to recall a representative.

Omondi’s remarks come amid continued debate over the powers of voters and political parties to remove elected leaders before their terms end.The issue has remained sensitive in Kenya, particularly when politicians make decisions that go against the wishes of their parties or supporters.

The legislator maintains that winning an election gives a representative a mandate from the people, which should not be taken away because of personal differences.

In his view, there must be a clear legal basis for recalling an elected member, including established gross misconduct where the law provides for it.Article 104 of the Constitution gives voters the right to recall Members of Parliament before the end of their terms.

However, the Constitution also requires Parliament to establish the grounds and procedures governing the process. The legal framework has faced challenges since a 2017 High Court decision invalidated key provisions of the Elections Act relating to the recall of MPs.

In July 2025,the Independent Electoral and Boundaries Commission confirmed that the necessary legal framework for recalling MPs and senators was not operational.Omondi is among the lawmakers who faced calls for removal following the controversial Finance Bill 2024.

The Orange Democratic Movement announced plans to initiate recall proceedings against six MPs who supported the bill, with the Suba South legislator among those targeted.

The proposed action raised questions about whether voting against the position of a political party or the expectations of constituents was enough to justify removing an elected representative.

In July 2026,the IEBC proposed amendments aimed at making the recall process easier. The proposed changes included additional grounds such as incompetence, gross misconduct and serious violations of the Constitution or other laws.

The proposals also sought to change the requirements for initiating recall petitions and reduce some of the legal barriers that had frustrated previous attempts.

However, the proposed amendments still require the legislative process to take effect. The debate continues to centre on how to balance accountability, the wishes of voters and the protection of elected leaders from politically motivated attempts remove them from office.
