If your own witness destroy your case, you have no case, AG should save the state – group of parties
According to report by Utvghana on Monday 2, November 2026, a group of political parties without representation in Ghana’s Parliament has called on the Attorney-General (AG) to consider withdrawing the State’s case, arguing that the evidence presented by the prosecution’s own witnesses has weakened its position.
The parties, comprising the Ghana Union Movement (GUM), National Democratic Party (NDP), Progressive Nationalist Forum (PNP), Great Freedom Party (GFP), Convention People’s Party (GCPP) and Liberal Party of Ghana (LPG), have expressed concerns about the direction of the legal proceedings.
In a statement, the group suggested that the testimony of witnesses called by the prosecution had raised questions about the strength of the State’s case. According to the parties, when witnesses presented by a party in court give evidence that undermines its own arguments, it becomes necessary to reassess the legal basis for continuing the proceedings.
They maintained that the Attorney-General should carefully examine the evidence already presented and consider whether pursuing the case further would serve the interests of justice.
“If your own witnesses destroy your case, you have no case. The AG should save the State further embarrassment,” the group stated.
The parties believe that the Attorney-General has a responsibility to ensure that public resources are not unnecessarily committed to legal proceedings where the available evidence may not adequately support the prosecution’s position.
Their comments have brought renewed attention to the importance of credible evidence, effective prosecution and accountability in Ghana’s justice system.
However, the final decision on whether to continue or discontinue the case rests with the appropriate legal authorities and must be guided by the evidence, applicable laws and the principles of justice.
The development is expected to generate further public discussion about the State’s handling of the case and the responsibility of the Attorney-General in ensuring that criminal and other legal proceedings are pursued on a sound evidential basis.
