No law compels President Mahama to explain dissolution of nine state boards

Hopeson Adorye, Director of Field Operations for the United Party, said President John Dramani Mahama has no legal obligation to explain his decision to dissolve the boards of nine state institutions.

Adorye’s remarks follow President John Dramani Mahama’s recent directive dissolving the boards of nine state institutions in the country.

Speaking on the GTV Breakfast Show on September 3, 2026, and shared on X, he said the president’s action falls within his discretionary powers and that the absence of a public explanation does not violate any legal requirement.

“The President is not obliged to state why he has dissolved it. If he wants to tell us, he will; there is no law compelling him to explain why it was dissolved,” he said.

President John Dramani Mahama dissolved the governing boards of nine state-owned institutions with immediate effect on September 2, 2026.

The affected institutions are Prestea Sankofa Gold Limited, Bulk Oil Storage and Transportation Company Limited (BOST), Volta Aluminium Company Limited (VALCO), Consolidated Bank Ghana Limited (CBG), Ghana Post Company Limited, the Road Maintenance Trust Fund, TDC Ghana Limited, the Ghana National Petroleum Corporation (GNPC), and the National Sports Authority (NSA).

A statement issued by Felix Kwakye Ofosu, Spokesperson to the President and Minister for Government Communications, directed the relevant sector ministers to take all necessary steps, in accordance with applicable laws and governing instruments, to implement the dissolution. The boards are expected to be reconstituted in due course.

In the interim, the management teams of the affected institutions will continue to oversee day-to-day operations under the supervision of their respective sector ministries. However, they are not permitted to take major policy, financial, or contractual decisions requiring board approval without prior authorisation from the appropriate authority.

No official reason was provided for the decision.

The move, meanwhile, follows an earlier directive under the Presidential (Transition) Act, 2012 (Act 845), which led to the dissolution of statutory boards appointed by the previous administration upon President Mahama’s assumption of office.
