Legal practitioner Frank Davies has criticised his colleague Martin Kpebu, questioning his understanding of “due process” in public discussions involving former Finance Minister Ken Ofori-Atta.

Speaking on JoyNews on April 8, 2026, Frank Davies, who is part of the Ghanaian legal team for the former Minister of Finance, argued that some of Kpebu’s public statements suggest a misunderstanding of how legal procedure works, wondering whether he is indeed a lawyer.

“I’m sorry to say this, but when the likes of Martin Kpebu talk, you wonder whether they are lawyers or carpenters, masons, or bricklayers. Look at what Martin Kpebu is saying. What does he understand by due process? What exactly does Martin Kpebu understand by due process from what he’s saying?

“He’s talking like a street boy. That, ‘Jorlo ee’ [thief], is that how a lawyer talks? So, when the man [Ken Ofori-Atta] has not been charged, what does Martin Kpebu expect him to do?

“When he (Martin Kpebu) was arrested by the Office of the Special Prosecutor (OSP), he was screaming that he had not been given the opportunity to call his wife. This is the kind of person who is condemning Ken?” he questioned.

Davies maintained that such commentary from Kpebu risks undermining the principle of fairness that due process is meant to protect.

He explained that until legal authorities formally charge an individual and establish wrongdoing through proper procedure, any expectation of punishment or public judgment is premature and inconsistent with the law.

Frank Davies’ comments were made in the broader context of discussions surrounding Ken Ofori-Atta’s legal situation.

The former Finance Minister recently regained his freedom after being held in the custody of United States Immigration and Customs Enforcement (ICE) over a visa overstay issue in Virginia.

His release followed a judicial order, according to his legal team.

In a statement issued on April 8, 2026, his solicitor, Justice Kusi-Minkah Premo of Minkah-Premo, Osei-Bonsu, Bruce-Cathline & Partners, confirmed that Ofori-Atta was released on April 7, 2026, and has since returned to his family.

His immigration matter in the United States is separate from the corruption-related charges he is currently facing in Ghana.
