Defence Witness Three Testifies in Moses Richards Trial

One Momodou Colley of Jabang Village and a photographer by profession, on Thursday May 19th 2011 testified as the third defence witness in the criminal trial involving the state against Moses B. Johnson Richards at the Banjul Magistrates Court presided over by acting Principal Magistrate Taiwo Ade Alagbe.

Colley told the court, during his evidence-in-chief that sometime in the year 2007 an incident happened at their village. Explaining the said incident to the court, DW3 revealed that he went out of the village and when he returned back to the village later in the day, he saw people throwing the properties of the villagers’ outside.

According to DW3, due to this incident the former director of NIA, Pa Jallow came and had a discussion with the elders of the village and he instructed them to take pictures of the things that were thrown outside. He disclosed that this was the time he brought his camera and took pictures of the incident and handed over the pictures to the alkalo (PW2).

The witness indentified the pictures and defence counsel Lawyer Antouman Gaye applied to tender the pictures and its’ negatives in evidence as exhibit, but the state counsel led by the director of Special Litigation, Deniel O Kulo objected and further applied for an adjournment for him to advance the reasons of his objection, because he has a case at the high court and he was running late.

The defence counsel objected but said that adjournment is at the discretion of the court. At that juncture the case was adjourned to 1st June 2011.
