In NIA Torture Case State Witness Absent in Court

FOROYAA Newspaper (Serrekunda) Mamadou Dem 22 April 2011 The case of former Inspector General of Police Ensa Badjie and former Police Prosecutor Tijan Badjie on Wednesday 20th April failed to proceed before Acting Principal Magistrate Alagbe Taiwo Ade of the Banjul Magistrates' Court. When the case was called, Tijan Badjie, the second accused, told the court that his counsel, Lawyer Lamin Mboge, and the first accused Ensa Badjie are at the High Court in Banjul.

In the ongoing alleged NIA torture case involving Lamin Darboe, Ebrima Drammeh, alias Jim Drammeh, Edrisa Jobe, alias Alagie Morr, and Omar Jammeh, on Wednesday, 20th April, failed to proceed before Acting Principal Magistrate Alagbe Taiwo Ade, as the third prosecution witness, Lamin Sima, was absent in the court.

Miss M. Mendy appeared for the State, while Aboulie Sisoho represented the first and second accused persons, Lamin Darboe and Ebrima Drammeh, and held brief for Loubna Farage, counsel for the third accused, Edrisa Jobe and Assan Martin represented the fourth accused, Omar Jammeh.

The case was adjourned to Tuesday, 3rd May, for cross examination of PW 3.

Readers could recall that Lamin Darboe, Ebrima Jammeh and Edrisa Jobe are standing trial on two counts of criminal offences. Count one states that the three accused persons sometime in May 2009 at the NIA head office in Banjul conspired among themselves to cause injury to the persons of Lamin Karbou and Lamin Sima.

Count two indicates that the accused persons sometime in May 2009, at the NIA head office in Banjul, with intent to cause grievous harm to Lamin Karbou and Lamin Sima, unlawfully wounded Lamin Karbou and Lamin Sima, by beating them with fist blows, electric cables and metals.

The charge against Mr. Jammeh is Common Assault contrary to Section 227 of the Criminal Code, Laws of The Gambia.
