NLA Wins High Court Decision To Carry On With New Commission Regime

An Accra High court on Wednesday dismissed the Application for Interlocutory Injunction restraining the National Lottery Authority from reducing the commission payabale to Lotto recevers (the Plaintiffs) from 25% to 20%.

In dismissing the Application, the Court noted that the Plaintiffs had failed to establish that they had a legal right which would or had been violated by the Defendants (National Lottery Authority).

Further the Court affirmed the provisions of Section 28 of the National Lotto Act, 2006 (ACT 722) which empowers the Board of the National Lottery Authority to determine the commission paid to Lotto Marketing Companies from time to time. The Court ruled the NLA should go ahead with the said reduction.

The decision of the court follows a Writ filed by National Lotto Receivers Union at the High court about 3weeks ago when the NLA announced a downward revision of their commission
to 20%.

The Lotto Receivers opposed this proposal even though the NLA Management promised them of an improvement in their sale volumes as newly acquired technology and the addition of other services and games will not put them in a disadvantage situation.

Despite all these assurances, the receivers went ahead to file suit against the NLA and the Governing Board to restrain them from performing their statutory functions.
