Former Nairobi Provincial Commissioner Jailed for Three Years Over Sh1.35 Billion Land Fraud.

Former Nairobi Provincial Commissioner Davis Nathan Chelogoi has been sentenced to three years in prison over a Sh1.35 billion land fraud case involving a piece of land in Lower Kabete, Nairobi.

Chelogoi was found guilty of five charges, including conspiracy to defraud, forgery, presenting false documents and forcibly occupying land belonging to other people.

The case involved a 7.39-hectare piece of land along Lower Kabete Road, which was claimed by two businessmen, Ashok Rupshi Shah and Hitenkumar Amritlal Raja.

The court found that Chelogoi used forged documents to support his claim of ownership of the property.

One of the documents was a letter of allotment dated January 31, 1995, which he claimed had been issued by the Commissioner of Lands.

However, the court heard evidence showing that the signature and official stamp used on the documents were not genuine.

During the trial, the prosecution called 19 witnesses, including land officials and experts who helped explain how the disputed documents were handled.

Chelogoi had defended his ownership claim, saying former President Daniel arap Moi had allocated him the land in 1995. He also maintained that he had paid Sh2.48 million for it.

However, the court found that he had failed to provide enough genuine documents to prove his claim.

His co-accused, former Assistant Deputy Director of Lands Andrew Aseri Kirungu, was acquitted after the court found that there was not enough evidence to convict him.

The court also ordered the cancellation of other title deeds and registration records linked to the disputed property.

The case has once again raised concerns about land ownership disputes and the use of fake documents in Kenya.

It also highlights the importance of protecting property rights and ensuring that land records are properly managed.
