George Saitoti’s Widow Rejects Bid to Exhume His Remains for DNA Test, Reveals Why
The family of former Kenyan Vice-President George Saitoti is facing a legal dispute after a man claiming to be his son sought court approval to have his remains exhumed for DNA testing to establish their biological relationship.
Margaret Wanjiku, Saitoti’s widow, is opposing the application filed by James Njage, who wants genetic testing conducted to determine whether the late politician was his biological father.
The dispute has brought attention to the legal and emotional challenges that can arise when questions about parentage emerge after a person’s death.
Wanjiku has raised several objections to the proposed exhumation, arguing that the process could cause significant emotional distress to members of the family.
She maintains that disturbing Saitoti’s grave for the purpose of collecting DNA samples would affect the family’s peace and dignity.
She has also questioned whether the proposed exercise would produce reliable results. According to the arguments presented against the application, the exhumation may fail to provide suitable biological material for meaningful DNA analysis.
Another major concern is the evidence presented by Njage to support his claim. Wanjiku argues that he has not provided sufficient documentary proof to establish that he is Saitoti’s son, making the request for exhumation unjustified at this stage.
The court will be required to consider the competing interests of the parties, including the claimant’s desire to establish his biological identity and the family’s concerns about disturbing the remains of the deceased.
DNA testing is widely used to resolve questions of biological parentage, but cases involving deceased individuals can present additional legal and practical difficulties.
Courts must consider the available evidence, the necessity of the proposed procedure and the interests of those affected.
Saitoti, who served as Kenya’s Vice-President, remains a prominent figure in the country’s political history.
