SARS Given Green Light to Sell MaMkhize-Linked Properties Worth R35 Million

The Durban High Court has given the South African Revenue Service (SARS) permission to sell five properties linked to businesswoman Shauwn “MaMkhize” Mkhize in Sandown, Johannesburg. The properties are valued at R35 million, and the decision comes as the costs of maintaining and securing them continue to increase.

Judge Jacqueline Henriques ruled that the properties could be sold before a separate legal case determines whether SARS has the right to use them to recover outstanding tax debts. The money raised from the sale must be kept in a trust account until the ownership and entitlement dispute has been resolved.

SARS argued that keeping the properties was becoming expensive. Court documents revealed that the tax authority was paying approximately R188,261 per month for private security. Insurance costs amounted to almost R98,000 every six months, while unpaid municipal charges had reached R1.79 million.

The properties were also reportedly in poor condition. A valuation found damp damage and signs of inadequate maintenance. In addition, the City of Johannesburg issued a notice after discovering that building improvements had been made on four properties without approved plans.

Judge Henriques said these financial and commercial concerns justified the urgency of the application. She also dismissed objections from Mkhize and her son, Andile Mpisane, who argued that the application was not urgent and that selling the properties could affect their right to a home.

The five properties are located next to one another and operate as a single compound. Four are registered under the name of Yaron Peretz, while the remaining property belongs to 22 Aston Investment (Pty) Ltd. Their combined market value is R35 million, although their estimated forced-sale value is R24.5 million.

The court found that there was sufficient evidence linking Mkhize to the properties as their beneficial owner. This included payments she and Zikhulise Group allegedly made towards most of the purchase price. Peretz had also testified during a tax inquiry that Mkhize handled the negotiations.

According to the report, Mkhize owes SARS R13.3 million in personal income tax. She is also personally liable for R112.5 million owed by Zikhulise Group, where she serves as a trustee and beneficiary. SARS has already recovered R6.1 million through auctions of vehicles, designer handbags and other seized belongings.

The judge noted that Mkhize and Mpisane had alternative accommodation available, rejecting their arguments that the sale would leave them without a home. The respondents were also ordered to pay the legal costs of the application.

SARS must now begin separate legal proceedings within one month to establish its entitlement to the proceeds from the property sales.
