DCI Arrest Westlands Man for Allegedly Spending KSh 6.7 Million Mistakenly Credited to Account

Detectives from the Banking Fraud Investigation Unit have arrested a suspect along Lantana Road in Westlands, Nairobi, for allegedly spending over KSh 6.7 million mistakenly deposited into his bank account.

The incident stems from an administrative transaction error on November 18, 2025, when a company processing multiple electronic payments deposited KSh 6,744,354 in addition to a legitimate KSh 72,000 shop rent payment intended for the suspect.

According to the Directorate of Criminal Investigations, the company sought to recover the erroneous funds after discovering the financial discrepancy, but the recipient allegedly proceeded to spend the money instead of returning it.

Following an exhaustive inquiry, the investigation file was forwarded to the Office of the Director of Public Prosecutions, which directed that formal criminal charges be preferred against the suspect.

The suspect is facing criminal charges under Section 35 of the Computer Misuse and Cybercrimes Act of 2018 for the intentional withholding of erroneously delivered payments.

Additionally, he faces distinct money laundering charges under Section 3(b)(1) read alongside Section 16(1)(a) of the Proceeds of Crime and Money Laundering Act, Cap 59A. The suspect remains in police custody undergoing standard processing pending his formal arraignment in court.

Law enforcement agencies have issued a stern reminder to members of the public emphasizing that funds mistakenly credited to personal bank accounts do not constitute the lawful property of the recipient.

Authorities stressed that spending, transferring, or failing to report erroneously deposited funds constitutes a severe criminal offense subject to immediate prosecution, asset forfeiture, rigorous financial investigations, and mandatory legal penalties under Kenyan law.
