Saitoti’s Widow Fights to Block Exhumation as Man Claiming to Be His Son Demands DNA Test
A legal dispute has emerged involving the family of former Kenyan Vice President George Saitoti after a man claiming to be his son moved to have his remains exhumed for DNA testing to establish his paternity.
Margaret Wanjiku, Saitoti’s widow, is opposing the request by James Njage who wants the former Vice President’s remains subjected to scientific examination to determine whether he was his biological father.
Wanjiku has raised concerns over the proposed exhumation arguing that the process could cause emotional distress to the family while potentially failing to produce useful DNA samples.
She maintains that the request is unjustified particularly because Njage has not presented documentary evidence to substantiate his claim of being Saitoti’s son.
The dispute places the former Vice President’s family at the centre of a sensitive legal battle involving questions of parentage the dignity of the deceased and the rights of individuals seeking to establish their biological identity.
DNA testing is commonly used in paternity disputes because it can provide scientific evidence to help establish biological relationships.
However, obtaining samples from a deceased person can present practical and legal challenges particularly when the family contests the proposed procedure.
Njage’s request seeks to resolve the question of his alleged relationship with the former Vice President while Wanjiku’s opposition highlights the potential emotional and practical consequences of disturbing Saitoti’s remains.
The dispute now raises questions about what evidence should be presented before such an intrusive procedure can be considered and how courts should balance a claimant’s interest in establishing paternity against the concerns of the deceased’s family.
The court’s determination will be crucial in deciding whether the proposed exhumation can proceed.
Until then, the paternity claim remains contested, and no conclusion should be drawn about Njage’s alleged relationship with Saitoti.
