IHC questions NAB raid on citizen’s home without warrant

The Islamabad High Court (IHC) has expressed displeasure over an alleged raid by the National Accountability Bureau (NAB) at a citizen’s residence without a warrant, during which valuables were reportedly seized, reported 24NewsHD TV channel on Monday.

Justice Khadim Hussain Soomro heard a petition filed by citizen Muhammad Waseem Malik, who claimed that an investigating officer raided his home, vandalized property and took away valuables despite no investigation, inquiry or reference against him being pending with NAB.

The petitioner told the court that he had submitted applications to the NAB chairman and director general but had received no relief.

During the hearing, Justice Khadim Soomro observed that the investigating officer had admitted to conducting the raid without a warrant and seizing items. The court was also informed that CCTV footage of the incident was available.

“An investigator enters a home without a warrant and carries away belongings,” the judge remarked, questioning whether it was lawful to take whatever items were found, including gold.

NAB prosecutor Rafay Maqsood told the court that the investigating officer had conducted the raid and that he would assist the court regarding the seizure of items. He also stated that search warrants were available, although arrest warrants might not have been obtained.

The court directed the petitioner to submit a formal application addressed to the NAB chairman regarding the alleged seizure of valuables.

Justice Khadim Soomro also directed the NAB prosecutor to appear fully prepared at the next hearing. The court subsequently adjourned the proceedings.
