“My Sexual Encounter With The 18-Year-Old Was Consensual, I Didn’t Rape Her” General Sibiya Says
Lieutenant-General Shadrack Sibiya, the suspended Deputy National Commissioner for Crime Detection, has denied the accusation of raping an 18-year-old woman. He stated in the Randburg Magistrate’s Court that their sexual encounter was mutual.
On Tuesday, September 29, Sibiya, 59, denied the allegations during his formal bail application. He has also denied the other allegations against him, describing the charges as “false and fabricated,” as stated in his affidavit, which was read in court.
The senior police officer is currently being charged with five offences, including allegations of sexual grooming of a 16-year-old girl, trafficking in persons, and rape.
The defence of Sibiya argues that the sexual encounter with the 18-year-old was consensual and that she had consented to engage in sexual intercourse with him. The State’s allegations in the charge sheet are explicitly contradicted by his version.
The prosecution alleges that in May 2026, Sibiya accompanied the 18-year-old woman and her companions to a strip club in Sandton, where they subsequently proceeded to a hotel.
The State claims that the women were given alcohol, and that the 18-year-old subsequently fell incapacitated. The prosecution contends that Sibiya sexually assaulted her while she was incapable of consenting. These allegations have yet to be confirmed in court.
Sibiya has also denied allegations that he sexually groomed a 16-year-old girl via WhatsApp between July and August 2026. The State claims that he engaged in sexually explicit electronic communication with the girl and persuaded her to send explicit videos.
An additional charge of trafficking in persons pertains to allegations of sexual exploitation and the involvement of three individuals.
The matter has garnered substantial attention due to Sibiya’s senior position within the South African Police Service. He was apprehended on September 21 and has been held in detention at the Kgosi Mampuru II Correctional Centre in Pretoria.
His release on parole is being opposed by the State. Prosecutors have previously indicated that they are concerned about the possibility of witness intimidation and alleged intelligence that suggests Sibiya could potentially escape if she is detained at a police station.
It is anticipated that Sibiya’s parole application will emphasise his personal circumstances, the gravity of the allegations, and the State’s apprehensions regarding the potential for witness interference.
The senior officer who has been suspended has not been convicted of any offence. The criminal justice procedure will be necessary to evaluate the allegations against him, and he will be presumed innocent until proven guilty by a competent court.
