The Justice Minister And The Judges Are Wrong Not To Defend The Law: Prof Kwaku Azar Teaches Judges

Supreme Court says Michael Yeboah has dressed an election petition in the garb of a constitutional issue and so it has no jurisdiction to hear whether J. H. Mensah is disqualified under article 94(1)(b), then it must apply the same rule when Ankomah-Nimfah dresses an election petition in a constitutional batakari seek the disqualification of Gyaki Quayson under article 94(2)(a).

Nana Addo, then representing the defendant, was right in raising the preliminary objection in the J. H. Mensah case. The Yeboah Court was right in upholding the preliminary objection.

The Ankomah-Nimfah Court is wrong in not heeding to Yeboah precedent, which has been religiously followed by the Dauda, Zakaria, and subsequent Courts. The Justice Minister is wrong in not defending the law, as laid down in the Yeboah against Mensah case.

I will forever remain talkative as long as it perceives injustice anywhere.
