S’ Court orders NIMASA to pay N644m for breach of contract

The Supreme Court has ordered the Nigerian Maritime Administration and Safety Agency (NIMASA) to pay N644m ($4m) as damages for breach of contract.

NIMASA was initially sued by Marine Management Associates INC and Kamine Marine Consul-tancy Ltd before the case got to the Supreme Court.

Trouble started in December 1999 when the defunct National Maritime Authority which was later metamorphosed into NIMASA terminated a ten year pre-destination inspection contract signed January31, 1996 with INC and Kamine Marine Consultancy Ltd.

The High Court awarded $4,298,066 against the NMA but the award was set aside by the Court of Appeal, Lagos on July 18, 2008 before the apex court last Friday re-affirmed the decision of the High Court.
