Alleged certificate forgery: Court dismisses Braimoh’s suit against Obende

BENIN CITY—IT was jubilation galore for Action Congress of Nigeria, ACN, members in Edo North senatorial district of Edo State, after the Federal High Court, Abuja, dismissed the forgery case instituted against the Senator representing the district, Senator Domingo Obende by the senatorial candidate of Peoples Democratic Party, PDP, in April 2011 elections, Alhaji Yisa Braimoh.

Some groups in the state, including Etuno Solidarity Forum, ESF and Afemai Youth Solidarity Front, AYSF, lauded the judgment and urged Alhaji Braimoh of PDP to join hands with the incumbent Senator in the development of the area.

National president of the association, Dr. Oizamesi Adanini, said: “If you alleged, the onus is on you to prove it and if they couldn’t prove it, it becomes their undoing. I see it as victory for the masses. They wanted him not to even contest at all, it was victory because he also defeated them at the polls and I think they should now join hands with him to work.”

In the judgment by Justice Abdul Kafarati, the court held that the suit was wrongly commenced by originating summons instead of writ of summons.

A statement by Oziametu Akerele on behalf of AYSF, congratulated Obende and his belief in the judiciary.
