ICC chief prosecutor Moreno Ocampo has suffered a huge blow, after the Pre-Trial Chamber rejected his application to block lawyer Essa Faal from representing Head of public service Francis Muthaura.
Judge Ekaterina Trendafilova says Ocampo failed to prove that Faal was privy to information on the Kenyan case. She says although Faal worked at the prosecutor’s office, he had never accessed confidential documents concerning the Kenyan matter.
She has however cautioned the defense teams that the decision will be kept under review as the case progresses.
