A lawyer wants Chief Justice Willy Mutunga stopped from performing his duties because he did not appropriately take an oath of office as required under Article 74 of the Constitution.
The lawyer has also claimed in the suit that the CJ is unfit to head the Judiciary because he communicates with the dead and practices magic. Lawyer Harisson Kinyanjui argues that Justice Mutunga cannot uphold the dignity and the respect for the judiciary and the judicial system of Kenya while engaged in necromancy and wearing of a stud whose purpose is to connect him to unspecified ancestors.
Kinyanjui, who had unsuccessfully sought court orders in the past to stop Justice Mutunga from being appointed, filed an amended suit yesterday before the High Court in Nairobi. He wants the court to determine if Mutunga has appropriately taken oath of office before he can continue performing or executing functions of the CJ.
The lawyer also says the CJ is unfit to hold office because he communicates with the dead. He says that The CJ did not take oath or solemn affirmation of office .
Justice Mutunga who had declared in the past that he is a man of all faiths should have sworn under all religions he professed, according to the lawyer.
Justice Mutunga while being sworn in at State House Nairobi on June 20, the lawyer claims, had only used one unmarked red book and purportedly read the expressed oath. He did not take any other oath, the lawyer says.
The CJ and his deputy Nancy Baraza has been named as an interested party in the case while the respondents are the Judicial Service Commission and the Attorney General.
