Four voters have moved to court seeking to stop ODM elections scheduled for next month. Japheth Kiio, Julius Gaya, Vincent Ouma and Jeremiah Ambaassaah have sued the chief government legal advisor, registrar of political parties, ODM and the committee on implementation of the constitution.

They say if allowed to go on, they will violate the constitution as some state officers who are not supposed to seek posts in party politics, are standing.

According to the voters, Cabinet ministers who are elected MPs have to choose between being party officers or their appointed positions as ministers. They want the court to give its interpretation on whether the law applies to only appointed state officers, or even elected MPs.

An order is sought to restrain ODM and the registrar of political parties from accepting any participation by state officers offering themselves for elections as party official. ODM secretary general Anyang’ Nyong’o yesterday said the grassroots elections will go on as scheduled. He said he has not been served any orders blocking the planned elections which will be conducted countrywide starting tomorrow up to July 5.
