A criminal law lecturer says while several sexual acts may sound repulsive and immoral, they do not necessarily constitute a crime.
A key ingredient in sex crimes, according to Kissi Agyabeng of the Ghana Law School, is what the penis ‘penetrates’ during the sexual act. So oral sex or sexual acts involving the penis, apart from penal penetration of the vagina could land one in trouble.
His submissions follow the developing controversy over what the law means by the phrase “unnatural canal knowledge” which is being used against gays in Ghana.
The subject has been re-ignited after the Moderator of the Presbyterian Church, Right Reverend Professor Emmanuel Martey, described the practice of homosexuality as abnormal and filthy.
Former Presidential Advisor on reproductive health, Prof. Fred Torgbor Sai has contested the claim and has called for a legal definition of what constitutes unnatural canal knowledge.
