Lawyer K. Mboge Continues Testimony in His Defence

Lawyer Lamin L.K Mboge on Monday 20 June continued his testimony at the Banjul Magistrate Court.

Lawyer Mboge told the court that Saikou Barrow has reported the matter to the police and after that Mr. Barrow did not come on Thursday but he came on Monday. He said when he came, he informed Mr. Sowe to serve the respondent at the property. He said the two left in the morning and he did not hear from him until in the evening. He added that when he called on the telephone and asked about the matter of Exhibit A, he thought the motion is for eviction and what he sees on the motion is an affidavit that he (Barrow) spoke to his father, who told him he did not thumbprint; that he instructed him (Mboge) to file the motion and must accompany an affidavit.

Lawyer Mboge said since Barrow’s father was not available, he instructed his assistant to go and file the motion. “I remember that he (Saikou) authorized me to file that motion”, said Mboge.

“We had lengthy discussion on the telephone but he did not understand. The next day he called the honourable minister about the motion I filed and called Barrow who said he and his father are not going to court again on this matter relating to the compound; that I should withdraw the motion” said Mboge. “I told him that motion is dated 17 of November 2010 and it cannot be withdrawn that day until we go to court. I told him I can only withdraw the motion at court.

He said he is going to police to make a declaration that I have filed a false affidavit” said Mboge. Mboge continued to say that on that same day, Barrow said the two of them must go to the minister again for further directive from the minister. “I told him i cannot go to the minister because I am in charge”, said Mboge. “I will go there when I need his advice” said Mboge. He said the same day in afternoon he received a call from Makalo, police officer PW2, who said that Saikou has lodged complaint that he made a false affidavit for him without his authority. He said he called the minister and told him that Saikou Barrow has reported the matter to the police that I return his money and files to close the case.

The case was adjourned to Monday 24 June 2011.
