Court Deports Two Liberians for Unlawful Entry

Jillo Kadida 20 June 2011 Nairobi — Dr Willy Mutunga has taken office as Kenya's Chief Justice with a vow to help recover public trust on the judiciary. Speaking at the steps of the Nairobi Law Courts moments after he was sworn into office, Dr Mutunga said "it should no longer be possible to speak about corruption and the judiciary in one breath." He said: "I commit, at the personal and institutional level of the judiciary, to ensure that the courts are accessible to and for all and that the rulings, judgments and pronouncements from the judiciary quench the thirst of the just and uphold the deeds of the law-abiding." Dr Mutunga was sworn into office at State House Nairobi on Monday together with his deputy, Nancy Baraza and the country's new Director of Public Prosecution Keriako Tobiko

Acting Principal Magistrate Alagbe Taiwo Ade of the Banjul Magistrates’ Court on Friday, 17th June, admonished and discharged James Wonyeh and Sampson Montgomery (both Liberians) who were charged with entering into the Gambia without pass or permit, contrary to the Laws of The Gambia.

The trial magistrate said it is not clear whether the accused persons intended to come to the Gambia but that they have learned their lessons.

The magistrate, after admonishing and discharging the two accused persons, deported them back to their country, Liberia, and ordered that they be given the sum of five hundred US dollars to facilitate their journey back home.

Cadet ASP Manneh applied for the court in accordance with section 147 of the Criminal Procedure Code, to make an order for the small canoe that brought in the accused persons into The Gambia and which was grounded at the Navy headquarters be returned to its rightful owner.

The trial magistrate subsequently ordered that the said canoe be returned to the owner and for the order be served to the Navy authorities.
