PDP Asks Court to Dismiss CPC Petition Against Jonathan

Malachy Uzendu 16 June 2011 Abuja — National leadership of the Peoples Democratic Party (PDP) yesterday set up an in-house committee to fashion out how to resolve the problems brought about by the emergence of Alhaji Aminu Tambuwal and Chief Emeka Ihedioha as Speaker and Deputy Speaker respectively of the House of Representatives. The party had zoned the position to the South West zone, while the North West was to produce the Deputy Speaker.

The peoples Democratic Party has asked the presidential election tribunal to dismiss the petition brought by the Congress for Progressive Change challenging the election of president Goodluck Jonathan.

In a notice of preliminary objection filed on behalf of the party by chief Joe-Kyari Gadzama, the party wants the petition dismissed or struck out on the ground that it was filed on a sunday which is not a working day.

Chief Gadzama said that the registry of the tribunal does not open on a Sunday and therefore ought not to have accepted the petition for filing on a Sunday which is a public holiday.

Alternatively, the party prayed the tribunal to strike out the names of the chief national electoral officer, professor Attahiru Jega and the resident electoral commissioners of Abia and Zamfara states on the ground that they are not necessary parties to the petition.

The party also wants the tribunal to strike out some paragraphs of the petition which contains complaints against the Nigeria police force, Nigeria security and civil defence corp and the Nigerian army who are not parties to the petition on the ground that the petitioner failed to join them as necessary parties despite complaints made against them.
