The ICC judges have dismissed the case in which the Kenya government sought to stop the Hague prosecution of the Ocampo Six suspects in the 2007-08 post-election violence.
Attorney General Amos Wako has indicated that he intends to appeal against the ruling saying the government was not given an opportunity to respond to some of the issues raised before the ICC judges made their ruling.
What is clear to all and sundry is that the government has failed to convince the ICC judges that it is doing anything to address the concerns that the Chief Prosecutor Luis Moreno Ocampo has raised.
As it is, not many Kenyans have any faith that anything will come out of the fresh investigations into the violence as ordered by the Attorney General.
The delays in the appointment of the Director of Public Prosecutions and the shenanigans surrounding the appointments of the Chief Justice and the Deputy Chief Justice may be an indication of just how (un)ready and (un)willing the government is in investigating and prosecuting the suspects.
What hope is there that Kenyans can expect to be able to put the events of the last election behind them before they face yet another one?
