THE Kitwe High Court has jailed a Ndola resident for 25 years with hard labour for unnatural offences.

High Court Judge Judith Mulongoti jailed Grey Servana, 59, of house number 1 Senanga Close in Kansenshi who was charged with unnatural offence after he had carnal knowledge of a child against the order of nature on November 5, 2009.

He was accused of having sex with a 12-year-old girl through the anus.

Servana, who was convicted by the Chingola magistrate court applied to the High Court to have the appeal heard before sentencing him.

The court heard that the girl used to see Servana on her way to school at BP Garage in Chingola and on the particular day, he called her and later had sex with her.

The girl, a grade seven pupil, feared to tell her mother but later revealed to her teacher what Servana had done.

She was taken to the hospital and a medical report revealed that the girl had bruises on the anus with dry blood clots.

In defence, Servana said the girl together with her friend used to go to ask for money from him and that he could not have had sex with her because he was impotent.

And in his ground of appeal, Servana said the lower court had erred and misdirected itself when it held that the prosecution had proved the case beyond all reasonable doubt when the weight of the evidence did not go to support such findings.

Servana has since applied for notices of appeal to the Supreme Court against his conviction and sentence on grounds that the sentence was excessive.
