Justice Joseph Enwa Ikpala of the Special Criminal Court (SCC) in Banjul has ordered the immediate transfer of a murder case involving the state against one Chanado Gaye, to the Basse High Court in the Upper River Region for trial.

The accused, Chanado Gaye, is alleged to have caused the death of his father, Gibbi Gaye with malice afterthought, by stabbing him with a sharp stick, in Loumen Village, in the Upper Niumi District of North Bank Region.

Months after the accused person took his plea, the Special Criminal Court reliably learnt that the prosecution had difficulty in getting its witnesses to appear in court.

At the last sitting, the presiding judge, Justice Joseph Enwa Ikpala pointed out that difficulty in getting the prosecution witnesses to come to court cannot hinder the hearing of the said case.

Justice Joseph Ikpala declared that the accused person cannot go unpunished and therefore ordered that the case be transferred to the Basse High Court for trial.
