Multiple sources said the die is not officially cast, but the powers that be think there is enough evidence to prosecute Gibson. However, the same sources said there is not enough evidence to prove beyond a reasonable doubt that Oksana extorted him, notwithstanding that she demanded $15 million from him in return for keeping tapes of his violent racist rants secret.
The turning point for prosecutors, sources told TMZ, was the fact that prior to Grigorieva going to the Sheriff’s Department and accusing Gibson of domestic violence, Gibson’s family law attorneys filed a declaration in the family law case, in which Gibson admitted to slapping Grigorieva, claiming it was because she was shaking their one-year-old daughter Lucia and he feared Shaken Baby Syndrome.
The charge against Gibson would likely be misdemeanour domestic violence and he will not be charged with a felony. Misdemeanour domestic violence carries a maximum penalty of six months in jail.
Sources said the extortion investigation has become a bone of contention between the District Attorney and the Los Angeles County Sheriff’s Department. Sheriff’s investigators believe there is sufficient evidence – much of which has not been made public – to prosecute Grigorieva, TMZ reported. The District Attorney does not agree.
Sources told TMZ that the decision is expected in the next two weeks, and very possibly this week.
