EFF's Sinawo Thambo apologises to PA's Kenny Kunene after legal threat

EFF spokesperson Sinawo Thambo has apologised to PA deputy leader Kenny Kunene and removed posts published on social media platform X, following a lawyer’s letter threatening legal action for “peddling defamatory, malicious and unsubstantiated allegations”. 

This comes after Thambo had made a number of posts, alleging Kunene had paid R400 000 bail for alleged crime kingpin Katiso KT Molefe, implicated in the 2022 murder of music producer DJ Somebody, among others. 

On Saturday, lawyers for Kunene sent Thambo a five page letter over posts on X between October 8 to 10, calling on him to withdraw the posts and make a public apology. 

“The statements in question collectively create a false and damaging inference that our client is a corrupt individual engaged in criminal conduct. The defamatory allegations are calculated to defame and portray our client as being involved in unlawful activities and associated with alleged controversial or suspected criminals.

“These allegations are entirely unfounded and misleading. The dissemination of such content is not only defamatory but also intended to unjustly harm our client’s reputation and public standing,” the letter by Kunene’s lawyers read. 

Thambo on Tuesday wrote back, confirming the posts had been deleted and also issued an apology on X. His post on X noted that he withdrew the posts made on October 8 and 10 about Kunene and apologised for any harm caused. 

His letter in response to Kunene’s lawyers further read: “In this letter, I do not intend to answer to all the allegations contained in your abovementioned letter and my failure to do so shall not be construed as an admission of the same. I hereby confirm that the posts published on the 8th and 10th of October 2025 concerning Mr. Kenny Kunene (“Mr. Kunene”) have since been deleted.

“I further confirm that I have issued an apology to Mr. Kunene on my X profile (@Sinawo_Thambo) apologising for any harm caused therein. A copy of the apology is attached hereto marked as “A”. I undertake to refrain from making or publishing any statements or posts that may be malicious and/or defamatory towards Mr. Kunene in the future.”
