By Section 134 Of The Constitution, Tinubu Can Not Be Sworn In As President – Datti Baba-Ahmed

It is common knowledge that the Labour Party and its presidential candidate, Peter Obi have filed their petition challenging the victory of APC’s Bola Ahmed Tinubu. While speaking about the said petition in an interview with Arise TV, Peter Obi’s running mate, Yusuf Datti Baba-Ahmed said going by section 134 of the Nigerian Constitution, Bola Tinubu can’t be sworn in as president.

According to Baba-Ahmed “We are not just talking about losing the election, we are now talking about a constitutional breach. Where you have a constitutional breach, there is no president-elect. I beg to say that by the standard meaning of section 134, we do not have a president-elect in Nigeria today. You cannot swear in a president whose certificate of return assaults the Constitution because the constitution is the platform on which the presidency rests”.

Explaining what section 134 of the Constitution is all about, Baba-Ahmed said ” Section 134 says the president shall have scored 25 percent in at least two-thirds of the state of the federation and the Federal Capital Territory, Abuja and it could not be any clearer than this. The Constitution is not a puzzle to be solved, it is a document to be followed. Right now, technically and Constitutionally speaking we don’t have a president-elect by the standard definition of section 134. Even if they swear in Tinubu it will be unconstitutional”
