Magistrate Court Grants Bail To Prof. Abiola Who Allegedly Assaulted Female Police Officer

A Wuse Zone Six Chief Magistrates’ Court in Abuja on Wednesday granted bail to Prof. Zainab Abiola and her domestic staff, Rebecca Enechido.

Magistrate Elizabeth Wonu, having listened to the arguments of both counsels regarding the bail application, granted them bail with specific terms and conditions.

Ms. Wonu, in the ruling, said the court looked at the provisions of Section 229 of the Penal Code law, which is applicable in Northern Nigeria and is used in a criminal proceeding.

The court also revealed that it looked at the provisions of Section 277 of the Criminal Procedure Code.

She said that the court had jurisdiction to entertain the charge of attempt to commit culpable homicide can also grant bail.

Ms. Wonu disclosed that, however, because the defendants had been in detention for 12 days, the court would grant bail.

The magistrate, therefore, granted the defendants bail and mandated that the defendants must provide two reasonable sureties with a fixed address.

The court also ordered that the sureties must swear to an affidavit of means which must be residents within the jurisdiction of the court.

The court, in its ruling, also said the sureties must show proof whether they are tenants or landlords.

The court ordered the defendants to report to the police FCT command every Monday until Nov.1 to enable them to be arraigned in a competent court.

The court concluded that the court order would abate if the prosecution failed to arraign the defendants within the time stated.
