He stated that\u00a0Ksh39.95 million\u00a0of the payout matched the\u00a0performance guarantee, compensating the firm for the violation of its rights.<\/p>\n<p data-start=\"495\" data-end=\"694\"><em>\u201cIn my very humble view, the Respondent\u2019s (KICC) conduct in this whole process does not demonstrate transparency or accountability in the handling of the procurement,\u201d<\/em>\u00a0Justice Mugambi\u00a0remarked.<\/p>\n<p data-start=\"696\" data-end=\"847\">The court found that\u00a0KICC management\u00a0was aware of the contract\u2019s timelines but failed to keep the contractor informed, leaving the firm in limbo.<\/p>\n<p data-start=\"849\" data-end=\"1136\">According to\u00a0Mukesh Halai, director of\u00a0Parbat Siyani Construction Ltd, his company won the tender in\u00a02018\u00a0when KICC first advertised it. However, after a second tendering process, the firm secured the bid again and received an\u00a0official award letter on January 31, 2019.<\/p>\n<p data-start=\"1138\" data-end=\"1391\">The company was formally awarded the contract in\u00a0April 2019\u00a0and invited for\u00a0negotiations and a design presentation on May 13, 2019. However, the contract signing, initially scheduled for\u00a0May 16, 2019, was postponed for further discussions.<\/p>\n<p data-start=\"1393\" data-end=\"1558\">On\u00a0May 22, 2019, the company submitted a\u00a0Ksh39.95 million performance guarantee\u00a0from I&amp;M Bank as required by the\u00a0request for proposal (RFP)\u00a0guidelines.<\/p>\n<p data-start=\"1560\" data-end=\"1652\">Days later,\u00a0KICC canceled the contract, citing\u00a0\u201ccircumstances beyond our control.\u201d<\/p>\n<p data-start=\"1654\" data-end=\"1925\">KICC CEO\u00a0James Mwaura\u00a0argued that\u00a0no formal contract was signed, emphasizing that\u00a0a notification of award does not constitute a binding agreement. He added that the contractor\u00a0failed to submit the performance guarantee within the required 28-day period.<\/p>\n<p data-start=\"1927\" data-end=\"2145\">Justice Mugambi ruled that the government\u00a0deliberately delayed the process, causing the tender to lapse. He criticized\u00a0KICC\u2019s handling of the procurement, stating that it lacked\u00a0fairness and transparency.<\/p>\n<p data-start=\"2147\" data-end=\"2386\"><em>\u201cIt is my finding that the manner in which the respondent treated the petitioner does not align with the principles of procurement as set out in Article 227 (1).
