The Special Prosecutor, Kissi Agyebeng, has noted that his office can not state unequivocally that it would be able to extradite former finance minister Ken Ofori-Atta.

Speaking in a recent interview with veteran broadcaster, Kwaku Sintim-Misa (KSM), Kissi Agyebeng explained that the extradition of Ken Ofori-Atta into the country is not a cast-in-stone process as speculated in the media.

According to him, the country can go through all the necessary procedures; however, it is up to the United States government to release Ken Ofori-Atta to Ghana.

“Since he is in a foreign country, I can not put a date on it. The central authority, in respect of its extradition matters in the US, could decide one thing. The president of the United States can’t step on it and block it and say no.

“So far as he is in the United States of America, we cannot put a date on it that we are bringing him today or tomorrow. Anyone who talks with certainty that in an extradition process you are going to get the person at all costs certainly doesn’t know what he’s about,” he said.

Ofori-Atta was first identified by the OSP in January 2025 as a suspect in several corruption-related cases, including alleged irregularities in contracts with Strategic Mobilisation Ghana Limited (SML), expenditures linked to the National Cathedral project, and issues in health and tax refund operations.

He was declared a fugitive in February 2025 after failing to honour multiple OSP summonses.

His lawyers later requested that his name be removed from the wanted list, promising he would return. However, after he again failed to appear before the OSP in June 2025, his fugitive status was reinstated, and the OSP indicated it would pursue extradition while maintaining the Interpol Red Notice.

Ten months after being first declared a fugitive, Ofori-Atta has neither been arrested in the United States nor voluntarily returned to Ghana.
