The Unexpected Legal Blow Closing the Window on Former CS Raphael Tuju’s Karen Empire
The legal battle over the extensive real estate portfolio of former Cabinet Secretary Raphael Tuju has reached a critical turning point following a decisive ruling by the Commercial Court in Nairobi.
The court officially removed temporary preservation orders that previously shielded the high-end Entim Sidai Wellness Sanctuary in Karen from commercial auction by the East African Development Bank (EADB).
This major legal setback demands immediate public attention because it removes the final judicial barrier preventing lenders from liquidating the multi-billion-shilling establishment to settle a decade-long financial debt.
According to verified court documents and judicial updates from the High Court Commercial Division, the regional lending institution successfully argued that previous preservation conditions had not been met by the borrower.
While the court had earlier granted a narrow window allowing Tuju’s corporate outfit, Dari Limited, to preserve the Tree Lane property upon depositing a required Sh50 million security in a joint account, the protection lapsed as lenders moved to execute statutory enforcement measures.
The dismissal comes after higher courts—including the Court of Appeal and the Supreme Court—consistently upheld the underlying loan enforcement judgment.
“Having reviewed the applications and previous rulings, the court finds that issues regarding the statutory power of sale have been fully determined by competent courts.”
The core dispute stems from a multi-billion loan facility initially extended to Dari Limited and guaranteed by the former minister’s family to fund the expansion of luxury hospitality infrastructure in Karen.
The financial obligations subsequently led to international litigation, where the High Court of London ruled in favor of EADB before the decision was formally ratified by Kenyan judicial authorities.
With the lapsing of the temporary stay order, receivers and auctioneers have been granted full statutory clearance to proceed with the realization of the secured commercial assets.
Per official legal briefings, financial analysts note that the lifting of protective stay orders effectively exhausts the primary litigation options for the former minister’s defense team.
Under Kenya’s Land Act, auctioneers must ensure the forced sale value does not fall below seventy-five percent of current market evaluations.
As lenders prepare public notices for the high-value Karen establishment, this landmark judgment sets a heavy precedent regarding the enforcement of cross-border financial contracts and statutory charge rights across the country.
