“Respect the Constitution”: Natembeya Questions County Commissioner’s Role in Masinde Muliro Market
Trans Nzoia Governor George Natembeya has questioned the involvement of County Commissioner Hassan Allasaw Hussein in the allocation of business stalls at Masinde Muliro Market, demanding an explanation of the legal authority guiding his participation.
In a strongly worded statement, Natembeya called on the commissioner to respect the Constitution of Kenya, 2010, arguing that the responsibility of managing and regulating markets falls under county governments.
The governor cited the Fourth Schedule, Part 2, paragraph 7(a) of the Constitution, which places trade development and regulation, including markets, under the functions of county governments.
Natembeya questioned why the County Commissioner’s office was participating in the allocation process, asking him to explain the legal authority under which his office was involved.
He also sought clarification on who had the lawful mandate to distribute the business stalls and what criteria were being used to ensure that the exercise was transparent, fair and free from favouritism.
The governor further accused the commissioner’s office of continuing to participate in the allocation despite what he described as express court directives barring such involvement.
According to Natembeya, the alleged disregard of the court orders could amount to contempt of court, raising further questions about the administration of the market allocation exercise.
He challenged Hassan Allasaw Hussein to append his signature to the list of beneficiaries if he believed his office had the legal authority to oversee the process.
Natembeya also demanded that the commissioner make the complete list of beneficiaries public so that residents and traders could know who had been allocated the stalls.
His remarks have brought renewed attention to the dispute surrounding the allocation of business spaces at Masinde Muliro Market, particularly the question of which government office has the authority to oversee the exercise.
The governor concluded by directly appealing to the commissioner to respect the Constitution and ensure that the allocation process follows the law.
