SARS Tightens the Net Around Shauwn Mkhize Thre High Court Authorises Sale of Attached Properties

After a KwaZulu-Natal High Court authorized a curator appointed by SARS to sell properties attached to Shauwn Mkhize, her son Andile Mpisane, and other respondents, the South African Revenue Service (SARS) achieved a major legal victory in its continuing tax dispute with the Durban businesswoman and socialite.

In a significant development in the efforts of the revenue service to recover outstanding tax liabilities, the court also ordered Mkhize and the co-respondents to pay the application costs.

As a result of the verdict, SARS will once again be pursuing assets connected to Mkhize and entities associated with her in an effort to collect on her increasing tax liabilities.

Claims in the case state that Mkhize owes the South African Revenue Service (SARS) over R13.3 million in back taxes and penalties. The R112.5 million tax debt of Zikhulise Group allegedly has her personally responsible as well.

Although the exact amounts recoverable through the most recent court-approved sale will be contingent upon the applicable proceedings and outstanding obligations, the combined liabilities demonstrate the magnitude of the tax recovery struggle.

The most recent turn of events is the culmination of years of conflict between SARS and Mkhize over his tax affairs, which have included various legal entities, accusations of financial wrongdoing, the seizure of assets, and the eventual liquidation of his company.

During the 2024–25 period, SARS allegedly ramped up its efforts to recoup overdue funds by shifting its attention from corporations to individual assets, family trusts, and Royal AM, a football club owned by Mkhize.

To protect assets that may be linked to unpaid taxes, the revenue service has sought preservation measures and search-and-seizure authorization in the past.

In its pursuit of justice, SARS also sought to have 14 high-end vehicles linked to Mkhize auctioned off. A reported tax liability of about R125.9 million was offset by the measures, which were part of a larger strategy.

These recovery proceedings have progressed to a new stage with the most recent High Court order allowing the curator to sell the attached properties.

Her association with Royal AM, high-profile lifestyle, and business interests have brought Mkhize—formerly Shauwn Mpisane—great public attention during the over twenty-year dispute between SARS and her.

The amount of money that SARS is able to recoup from the court-authorized sale will depend on the claims made against the assets and the proceeds that are realized.

The most recent decision compounds an already protracted tax dispute by presenting Mkhize and the other respondents with yet another substantial legal obstacle.
