Picture: Vutivi Maluleke/Facebook The Limpopo High Court in Polokwane has dismissed the bail appeal of Tshwane Metro Police Department (TMPD) officer Peter “Gagash” Nonyane and his wife, attorney Charlotte Tibana, who are accused of theft, fraud and money laundering involving R11m allegedly taken from deceased estates.

The ruling was delivered on October 22 after a virtual hearing the day before. National Prosecuting Authority (NPA) spokesperson Mashudu Malabi confirmed that the appeal had been dismissed. Following the dismissal of their bail appeal, Nonyane and Tibana will remain in custody pending further proceedings.

The couple are accused of allegedly taking money from accounts belonging to 15 deceased estates. They face charges of theft, fraud and money laundering. The allegations stem from the administration of deceased estates where Tibana was appointed as an executor. They face a combined 123 charges.

According to the state, the accused unlawfully concealed the nature, source, location, disposition and movement of the money.

The state alleges that about R1.65m of the proceeds was used to purchase a pre-owned Mercedes-Benz AMG G63 from a dealership in Pretoria.

It further alleged that Nonyane used some of the money to make stokvel contributions and finance the construction of a residential property.

The bail appeal comes as two other accused in the case were granted bail by the Polokwane Magistrate’s court on October 8. Rirhandzu Tibana, the younger sister of Tibana, and businessperson Jabulani Nephtal Maluleke were each granted bail of R60,000.

Malabi said the state did not oppose their release.

As part of her bail conditions, Rirhandzu must report to Letsitele police station every Friday between 8am and 4pm, while Maluleke is required to report to Pretoria police station during the same hours.

The matter has been postponed to November 6 for further investigations.
