Sifuna Suffers Blow In Quest To Adopt Linda Mwananchi Name As MP Challenges Process
A fresh hurdle has emerged in the push to rebrand The Equitable Party after a formal objection landed at the Office of the Registrar of Political Parties on October 21. The submission questions whether the party has followed its own constitution before the name change is recorded as complete.
Section 20 of the Political Parties Act requires any change to be made in line with a party’s constitution and rules. The writer notes that the party’s constitution separates the powers of the National Executive Committee from the authority needed to approve amendments.
Article 10.3.1 states that proposals affecting the party’s name symbol colours constitution and rules must go to the National Delegates Conference for approval. Articles 10.3.2 and 10.3.3 add stricter quorum and voting rules including a two-thirds threshold.
These provisions matter because the rebranding touches the party’s name and also its constitution colours and symbol.
The writer argues that the NEC resolution of October 8 may rightly mark the start of the amendment process. However it should not be taken as proof that every internal step has been completed if separate NDC approval is required.
The Registrar is asked to confirm that the proposal was approved by the competent party organ before the name change is recorded as final.
If the party relies on an NDC resolution the Registrar should also verify that the conference was properly convened. This includes notice to members and the composition of delegates. It also covers quorum and the voting thresholds.
The Registrar indicated in a communication dated October 13 that the statutory process remains open. She also said representations from members of the public must still be addressed. The objection urges her to settle these questions first.
