Big News About Wontumi’s Bail Exposed

US-based Ghanaian legal scholar Professor Kwaku Asare, popularly known as Kwaku Azar, has questioned allegations that some National Democratic Congress (NDC) supporters threatening to quit the party in 2028 over Chairman Wontumi’s possible release on bail constitute an attempt to undermine judicial independence.

The controversy centres on the reported reactions of some NDC supporters to the possibility of Bernard Antwi Boasiako, the New Patriotic Party (NPP) Ashanti Regional Chairman, being granted bail while pursuing an appeal.

Some commentators have expressed concern that the alleged threats could be interpreted as political pressure on the judiciary. However, Professor Azar believes the conclusion requires stronger justification.

In a Facebook post dated October 17, 2026, the legal practitioner challenged the argument that threats to withdraw political allegiance necessarily amount to intimidation of the courts.

He maintained that a person’s decision to abandon a political party does not, by itself, demonstrate an attempt to influence judicial proceedings or compel judges to disregard established legal principles.

Professor Azar questioned the connection between the alleged threats and claims of judicial interference, asking whether a threat to leave a political party could reasonably be treated as a threat against the judiciary.

He also disputed suggestions that the reported conduct showed that some NDC supporters considered the courts an extension of their party.

According to him, their concerns about a possible bail decision could indicate that they recognised the judiciary’s ability to reach conclusions that might conflict with their political expectations.

He argued that allegations of judicial intimidation or political control should be supported by clear evidence rather than inferred solely from the reactions of party supporters.

Professor Azar acknowledged that the reported threats might arise from disappointment, frustration or a misunderstanding of how judicial independence operates. Nevertheless, he insisted that such expressions of dissatisfaction did not automatically establish an attack on the courts.

Addressing the substantive legal issue, he said Chairman Wontumi’s application for bail pending appeal must be determined exclusively on its legal merits.

He stressed that neither political pressure nor threats to withdraw party support should influence the court’s decision.

Professor Azar stated that the court should grant bail if the applicant meets the relevant legal requirements and reject the application if those requirements are not satisfied.

His intervention adds to the ongoing public debate over the relationship between political interests and judicial independence in Ghana, particularly when court proceedings involving prominent political figures attract strong reactions from supporters of opposing parties.
