In a hearing in Los Angeles Superior Court on Wednesday (Oct. 14), Judge Shelley Kaufman ruled on the issue of whether Maceo would be permitted to take the stand at an upcoming hearing regarding Martinezâs request for a restraining order against her and the partiesâ subsequent custody battle. Maceo will be allowed to testify, but only about limited topics.
Martinez requested the restraining order on October 1, claiming that Berry âphysically abusedâ Maceo by âjumping on him, putting her hands around his neck, and choking himâ in an incident the prior weekend.
Martinez requested that Maceo be allowed to testify about the alleged confrontation in a hearing scheduled for Friday (Oct. 16). Berry objected, fearing that Martinez was coaching the child on what to say.
At Wednesdayâs hearing, Judge Kaufman said that Maceo will be allowed to testify on Friday, but the testimony will be âlimited to the request for the issuance of a restraining order.â Any other issues about his testimony, the judge said, will be decided âafter the Restraining Order Hearing has concluded.â
She seemed to nod to Berryâs concerns by specifying that âThe minor child shall not be coached.â
Maceo will testify in a closed courtroom, with only the parties, their lawyers, and court personnel allowed to attend.
Berry has denied Martinezâs abuse allegation, maintaining that she and Maceo were roughhousing rather than fighting. She has also completed a court-mandated parenting program amid the ongoing proceedings.
The actressâ 18-year-old daughter, Nahla, whom she shares with former partner Gabriel Aubry, previously submitted a sworn declaration defending her mother against Martinez's allegations.
