R11 Million Showdown: Kaizer Chiefs Take Action as FNB Stadium Legal Battle Takes a New Turn
A significant new development in a legal dispute that has been percolating for months is the formal appointment of solicitors by Kaizer Chiefs to defend themselves against an R11 million damages claim associated with an alleged stampede at FNB Stadium. One of the four defendants named in proceedings brought by Gauteng woman Nonhlanhla Celia Khumalo is the Soweto giants. Khumalo is reportedly pursuing a combined sum of R11 million in damages for injuries she allegedly sustained at the venue last year. The club’s decision to contest the claim in court rather than settle signals that they are prepared for a high-stakes legal battle that could have significant repercussions for stadium safety and event management in South African football.
The allegation is based on an alleged stampede that occurred during Kaizer Chiefs’ Betway Premiership match against Sekhukhune United at FNB Stadium on 16 September 2025. Amakhosi ultimately suffered a 3-1 defeat. Court documents indicate that Khumalo was in the process of passing through security checkpoints upon her arrival at the stadium when the crowd surged, causing her to be knocked to the ground and trampled. According to her legal team, security personnel did not render assistance to her, and she was ultimately liberated by a colleague. Before being referred to Chris Hani Baragwanath Hospital, she was treated at the stadium clinic. There, she underwent surgery for a fractured humerus and a fractured femur. She was discharged five days later. According to reports, the incident has resulted in Khumalo’s permanent disability.
Kaizer Chiefs, Stadium Management South Africa (SMSA), the Premier Soccer League (PSL), and the Minister of Police are all named as defendants in Khumalo’s lawsuit. Kaizer Chiefs are allegedly held primarily responsible under the Safety at Sports and Recreational Events Act for failing to implement adequate crowd management measures, as the home team and event organiser. The PSL is accused of failing to enforce statutory safety compliance under league rules, while SMSA is accused of failing to maintain safe entry and exit routes. The police are being accused of neglecting to coordinate crowd control with the other stakeholders. The claim is divided into three categories: R5 million for agony and suffering, R5 million for lost earning capacity, and R1 million for future medical expenses.
Legal proceedings have been duly initiated against all four defendants, as confirmed by Khumalo’s legal representatives at T Matubatuba Attorneys Inc. Attorneys have been appointed by the chiefs. The law firm informed KickOff that they are awaiting the filing of the plea or opposing papers by their attorneys. The firm stated that it is unable to provide further commentary on the case’s merits due to the fact that it is currently under judicial review. Vina Maphosa, the spokesperson for Kaizer Chiefs, had previously stated that the club was unaware of any litigation at the time of the initial report, and none of the other defendants had made any public statements.
The case is an addition to a series of legal and safety concerns that have been circulating in South Africa regarding stadium operations. This includes previous PSL sanctions against both Kaizer Chiefs and Orlando Pirates for spectator misconduct at FNB Stadium. Regardless of the outcome of the litigation, it has rekindled interest in the management of crowd safety at the nation’s largest football stadiums. The appointment of legal counsel by Kaizer Chiefs is a clear indication that the club is prepared to contest the claim rather than accept liability. The subsequent weeks will reveal the responses of the other defendants to the summons. The outcome of the legal process could establish a substantial precedent for accountability in stadium safety throughout South African football.
