Nahla Aubry is Halle Berry's 18-year-old daughter with former partner Gabriel Aubry. She answered the claims in a declaration filed in Los Angeles Superior Court on October 3. As reported by Page Six, which obtained the documents, Nahla wrote that she has lived with Maceo for most of his life. She said she has never seen abusive conduct.

"I have never seen my mom hit, slap, choke, grab, or physically abuse Maceo in any way," Nahla stated in the declaration.

"I have never seen my mom place her hands around Maceo's neck, put him in a chokehold, restrict his breathing, or engage in any conduct remotely resembling the allegations that have been made against her."

Nahla Aubry called Berry a loving and devoted parent. She said her mother can be strict when needed and expects rules and respect. She added that she never saw anything abusive in that parenting. Nahla said she spoke with Berry and Maceo by phone on September 29. Berry was driving him to school at the time.

Nahla said Maceo did not seem upset. She also wrote that she remembered Martinez beating her father in the driveway when she was little. She said she has never seen her mother act violently toward anyone or throw objects.

According to PEOPLE, Martinez said his concern remains Maceo's health and safety. He said his actions are meant to protect him.

Halle Berry filed her own declaration on October 5. According to PEOPLE, she said she has never physically, emotionally, or otherwise abused Maceo. She noted that she is a victim of domestic violence. She also said she helps other victims.

Berry asked the court to put the old 50/50 custody schedule back in place. She said text messages showed her distress after Maceo became physically aggressive toward her. She also submitted video. She said that video contradicted Martinez's account.

Her attorney, Marina Beck, spoke to Page Six on October 1. Beck called the filing meritless and misleading. She pointed to earlier court findings that Olivier Martinez had violated orders. Beck also said he had interfered with therapeutic and educational steps for Maceo.

Halle Berry was later seen spending time with Maceo in Los Angeles under the temporary visit limits. The next court date is still October 16.
