A job seeker in Kenya is asking the public for quick guidance after a company deposited a full month’s pay into her phone and later called to demand a refund.

According to her account, she was hired, but the company ended her employment within a week. She says the decision was theirs, she never walked away, and she did not ask for any payment afterwards. When the month closed, an M-PESA notification told her that 150,000 shillings had arrived from the firm.

The company then phoned her and asked her to return it. Her question to online readers is simple: should she send the money back?

The honest answer is that it depends on what she actually earned. An employee has a right to wages for the time worked, so a fair portion of the deposit, covering her one week, may legitimately belong to her.

The rest is a different matter. Money paid by mistake does not become the recipient’s property just because it reached her account, and refusing to return it can lead to a civil claim for recovery.

Advisers in employment matters suggest a calm, documented approach. She should leave the funds untouched for now. She should ask the company to put in writing how it calculated her earnings and how much it believes was sent in error.

Her offer letter or contract should be checked for the agreed salary and the notice period, because dismissal without proper notice can sometimes entitle a worker to extra compensation.

If an overpayment is clear, she should refund only that part and keep her M-PESA records, text messages and call logs as evidence.
