Madlanga vs Ratha Who Is Seeking the Truth?

The contrasting approaches associated with retired Justice Mbuyiseli Madlanga and Judge Ratha Mokgoatlheng have become a subject of public interest amid ongoing scrutiny of South Africa’s justice system.

Justice Madlanga chairs the Madlanga Commission of Inquiry, established to investigate allegations of criminality, political interference and corruption within the criminal justice system. His responsibility is to examine evidence, test allegations and establish the facts before making recommendations. South African Government +1

Meanwhile, Judge Mokgoatlheng presides over the high-profile Senzo Meyiwa murder trial at the Pretoria High Court, where testimony from witnesses, including Brigadier Bongani Gininda and individuals named Zungu, has attracted considerable attention.

The defence has challenged aspects of the State’s evidence, raising questions about the reliability of statements and the circumstances under which they were obtained. Some witnesses have also disputed previous statements attributed to them. SABC News +2

The difference highlighted by critics is the importance of ensuring that every allegation is properly examined rather than accepted without sufficient scrutiny.

In any criminal proceeding, the credibility of witnesses, consistency of statements and supporting evidence are essential considerations. Allegations must be tested through cross-examination and established legal procedures.

Ultimately, neither public opinion nor competing versions of events should determine the outcome of a criminal trial. The evidence presented in court and the applicable law must guide the final decision.

South Africans deserve a justice system that prioritises credible evidence, fairness and accountability, regardless of the individuals involved.
