Acting Police Minister Firoz Cachalia and KZN Police Commissioner Lieutenant-General Nhlanhla Mkhwanazi brought an urgent application that resulted in a strict interim order on Friday, 30 October, against the anti-illegal immigration movement, March and March.
National Police Commissioner General Fannie Masemola had defended the application, ensuring it was not meant to silence constitutional rights.
βWith the application, we donβt intend to prohibit lawful marches and protests of whatever nature, but what weβre against is breaking the law, damage to property, attacking people and injuring people,β he said.
The court agreed. Judge Peter Olsen ruled that March and March, led by Jacinta Ngobese-Zuma, can continue demonstrations, provided they comply with severe restrictions.
Police had specifically warned of an alleged plot to set fire to the Department of Home Affairs Refugee Reception Centre in Berea.

The court order immediately bars the movement from looting, destroying property or setting homes alight. Furthermore, protesters cannot cover their faces or carry weapons.
βIn connection with any march or gathering or demonstration the respondents are interdicted and restrained from possessing any air gun, imitation firearm, wearing disguises, masks or other items that obscure facial features and prevent identification,β the order reads.
Protests are also restricted to between 9am and 4pm.
